IMPORTANT CLAUSES OF THE
AGREEMENT
1. LEASING OF CONTRACTED HARDWARE, SOFTWARE
AND CONNECTED ACCESSORIES AND PROVISION OF COMPUTER EDUCATION SERVICES.
a)
The preparation of the computer lab and installation of the systems
shall be done at the risk and cost of the contractor.
b)
The contractor shall provide one additional computer of the
configuration of the node, separate Modem with one UPS (0.5 KVA) and one IT
assistant in each school for the execution of IT applications relating to the
administration and academics in the school.
Even in double shift schools the contractor shall provide one additional
computer, separate Modem with one UPS (0.5 KVA) and one IT assistant
exclusively & individually for each shift of the school. The principal of the concerned school shall
facilitate the provision of a separate room for this purpose in his respective
school.
c)
The contractor shall maintain the computer lab. , all the computer
hardware, software and other infrastructure in proper working condition through
out the contract period. A penalty
of Rs. 200/- per computer per day will be levied on the contractor for
any computer that is not
repaired/replaced within one day from the reporting of the fault / defect to the contractor. The
maintenance shall include replacement of spare
parts, if required. A penalty of Rs.200/- per day will also be levied on
the contractor for non -unctioning of the UPS and Air-Conditioners
individually.
d)
The contractor shall provide floppies, consumables and stationery as
detailed below to the school annually during the contract period within
30 days from signing the contract in the first year and during the month of
August in subsequent sessions. A penalty
of Rs. 5,000/- per month per school shall be levied on the Contractor for the
delayed supplies of these items to the schools concerned.
The following consumables
shall be supplied:
Floppy
- One
for each student from Classes VI to XII
Consumable - (i)
40 Computer Ribbons
(ii) At least 10
Ink Cartridge Black/color or as per requirement
Stationery - 40
Reams each of 500 sheets (1000 pages).
e)
The contractor will provide technically feasible Internet facility of speed not less than 64 kbps to all
computer terminals simultaneously for
unlimited use during teaching hours to the school. In case the connectivity is
through the Dial up modem, one dedicated telephone connection will be provided
by the contractor for the computer lab. The telephone bills, in case telephone
is being used for providing Internet, including rent for using the telephones
in the computer lab. will be paid by
the contractor. If Internet doesn’t
work, a penalty of Rs.200/- per day per school will be levied on the contractor
till the deficiencies are made good.
f)
The contractor shall provide three full time teachers in each senior
secondary school at his risk and cost. At least one teacher having the
qualifications viz. Master’s degree
preferably in Commerce/Science with at least
1 years Post Graduate Diploma in
Computer Applications OR Master’s degree
in Computer Applications (M.C.A) OR Master’s
degree in Science (Computer
Science) or Bachelors degree in Computer Engineering as prescribed / recommended by CBSE will be designated as
senior teacher. This teacher must possess an experience of at least 3 years in
the field of Computer Education. The other two full time teachers will be
designated as junior teacher who will be at least Graduates having at least one
year Diploma in Computer Education from recognized institutions or B.C.A. with
minimum 2 years experience in delivering Computer Education. Two junior
teachers shall be provided by the contractor in each secondary and middle
school. The teachers employed by the agency shall be answerable to the head of
the school for administrative purposes like marking attendance, change of
classes, casual leave etc.
g)
No teacher /instructor should
work in both shifts or in two schools simultaneously under any circumstances.
h)
The contractor shall ensure that the teacher attends the school
regularly and a substitute is provided
in his/her absence. If the teacher /
instructor provided by the contractor is absent from the school and no
substitute is provided, the contractor
shall be liable to pay a fine of Rs.200/-per day for absence of the teacher.
i)
The Instructor/IT Assistant shall attend the school during
summer/winter vacations. The IT assistant would normally work throughout the
year except for notified Government holidays. The Instructors may also be
required to attend schools during vacations, if so directed by the Director of
Education.
j)
The contractor shall train four teachers and one non teaching official
from each school every year as per the curriculum provided. The training shall be 6 hours a day, for duration
of 14 days.
k)
Monitoring of the Computer Education Project shall be done by the
Director of Education or by any person or team authorized by him.
l)
The contractor shall provide the address and contact number of Zonal
Coordinator and the hardware engineer to all the school heads so that the
discrepancies arisen could be sorted out swiftly.
m)
In the eventuality of theft /natural calamity in the computer lab, the
contractor shall replace the systems and associated infrastructure in the lab
within a period of one week to avoid penalty clause.
n)
The hardware of the reputed brand and from ISO 9001:2000, CE certified
companies shall be supplied by the contractor under the project. If at any point of time it is discovered that
the peripherals supplied or given as replacement of defective part/equipment
are not provided as per technical specifications provided in tender it will be
presumed to be theft of Govt. property and legal course will be adopted besides
imposing a penalty of Rs.200/- per day per school from the day of installation
on up to the date deficiencies are made good.
2. IMPLEMENTATION SCHEDULE:
Preparation of the computer lab, Installation,
testing and commissioning of Computer System and accessories shall be completed
as per the schedule given below :
Signing of Contract : Day 1
Commissioning
of systems & other
Infrastructure,
Commencement of course : 30 working days excluding Second
Saturdays, Sundays and Gazetted
Holidays from the date of signing the contract.
3. PENALITY AND TERMINATION FOR NON-FULFILLMENT
OF INSTALLATION / COMMISSIONING OF SYSTEMS.
If the preparation of the
computer lab, installation and commissioning of the system is not completed in
full within the stipulated period as prescribed in the implementation schedule,
a penalty at the rate of 1% per week of the total contract value will be levied
for a maximum period of 4 weeks, if the default is on the part of the
contractor. If installation and commissioning is not completed even within this
4 week period, contract will be terminated at the risk and cost of the
contractor, if the default continues to be on the part of the contractor.

The implementation schedule specified in the contract shall be strictly
adhered to.
a. The computer lab must be
available for inspection by the competent authority at all times.
b. No equipment shall be
removed from the school premises by the contractor without the concurrence of the school Principal / Head including for purposes of
replacement of spares, etc.
c. Safety, security &
insurance of the computer systems & other equipments and infrastructure
including furniture installed at the school shall be the responsibility of the
contractor during the period of contract.
d. The electricity charges for
running the computer lab in the school shall be borne by the contractor on
monthly basis as per the reading of sub-meter fixed. The sub-meter will be fixed by the contractor.
e. The bidder shall impart
Computer Education in English and / or Hindi as the medium of instruction, as
prescribed for the school concerned.

Bilingual Study Material shall be provided to the children. Hindi Medium study material for Hindi Medium
Children and English Medium study material for English Medium Children would be
supplied.
3.
The time table for the Computer Lab shall be prepared by the
Principal/Head Master/ In-charge of the school with the assistance of senior
instructor provided by contractor for the school. It shall be ensured that at
least 2 periods per week is allocated to each class from VI to X and periods of
class XI & XII are allocated as prescribed by CBSE. The computer lab shall
however be optimally utilized for all the 48 periods per week so that the
maximum number of students are benefited to receive computer education. The principal of the school concerned shall enroll
the students to receive computer education accordingly.

The instructor provided by the contractor shall work under the overall
control & supervision of the principal of the school.

Text Books including Study material, one for each student for classes
VI to X will be provided by implementing
agencies annually under the project. The study material provided by the agency
shall strictly follow NCERT books and CBSE syllabus for classes VI to X. The study material should be got approved by
the Technical Advisory Committee every year before printing &
distributing. The contractor shall
ensure delivery of the text books to the students from classes VI to X within
two months of signing the contract during the first year and in the month of
July in each subsequent session under the contract period. A penalty of Rs. 5,000/- per month per school
shall be levied on the contractor for delayed supplies of text books to
students. The text books should be
distributed to the students through the principal/Head of the concerned school.

No student shall be charged any fee by the contractor.

The contractor must ensure
that at least 70% of students pass in the subjects of Computer Science &
Informatics Practices in the exam. Conducted by CBSE. For every 1% fall in the
results of (1) Computer Science (2) Informatics
Practices and (3) Multimedia & Web Technology subjects
in the class XII examination below the level of 70% and up to 60%, the
deduction to the tune of 0.5% of the annual value of the contract shall be
made. If the results falls below 60% a deduction to the tune of 1% of the
annual contract value for every 1% fall of the result, up to 50% shall be made.
Beside the imposition of penalties as provided in this clause, the contract is
liable to be terminated if the results of the (1) Computer Science (2)
Informatics Practices and (3) Multimedia & Web Technology subjects in the
board examination falls below 50 %. These penalties may be imposed only if the
students have an attendance record of not less than 75%.
8.
The contractor shall submit
monthly report to the principal class wise regarding the progress of syllabus
covered in each month.
9.
The department will be at liberty to use the computer labs set up by
the contractors in the schools for official works and other enriched training
for computer education. The department
may use the computer lab during vacations and holidays for training/teaching or
any other desirable purposes.
10.
The false ceiling in the computer lab wherever required shall be
provided by the contractor.
